PRIVACY POLICY FOR VISITORS AND AUTHORIZED USERS

Welcome to Designs by Devin (the “Site”).

I understand that privacy online is important to users of my Site, especially when conducting business. This statement governs my privacy policy with respect to those users of the Site (“Visitors”) who visit without transacting business and Visitors who register to transact business on the Site and make use of the various resources offered by Design by Devin (collectively, “Services”) (“Authorized Users”).

“Personally Identifiable Information (‘PII’)” refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number, fax number, email address, financial profiles, social security number, and credit card information. PII does not include information that is collected anonymously (that is, without identification of the individual user) or demographic information not connected to an identified individual.

What PII is collected?

I may collect basic user profile information from all of our Visitors. I collect the following additional information from our Authorized Users: the names and email addresses of Authorized Users.

What organizations are collecting the information?

Nobody. I don’t give out any PII collected to any organizations.

How does the Site use PII?

We use PII to customize the Site, to make appropriate resource offerings on the Site. I may email Visitors and Authorized Users about research opportunities on the Site or information related to the subject matter of the Site. I may also use PII to contact Visitors and Authorized Users in response to specific inquiries, or to provide requested information. I may use PII to contact Visitors and Authorized Users for the purposes of personal and professional networking, or to connect Visitors and Authorized Users with others for the purposes of personal and professional networking.

With whom may the information may be shared?

PII about Authorized Users may be shared with other third-party vendors, but only with your express written authorization on a per instance basis. I simply will not share your information without your permission each time. I also offer the opportunity to “opt out” of receiving information or being contacted by us or by any agency acting on our behalf.

How is PII stored?

PII collected by Agile Devin is securely stored and is not accessible to third parties or employees of Agile Devin except for use as indicated above.

What choices are available to Visitors regarding collection, use and distribution of the information?

Visitors and Authorized Users may opt out of receiving unsolicited information from or being contacted by us and/or our vendors and affiliated agencies by responding to emails as instructed, or by contacting us through our contact page.

Are Cookies Used on the Site?

Cookies are used for a variety of reasons. I use Cookies to obtain information about the preferences of our Visitors and the services they select. I also use Cookies for security purposes to protect our Authorized Users. For example, if an Authorized Customer is logged on and the site is unused for more than 10 minutes, I will automatically log the Authorized User off.

How does Agile Devin use login information?

Agile Devin uses login information, including, but not limited to, IP addresses, ISPs, and browser types, to analyze trends, administer the Site, track a user’s movement and use, and gather broad demographic information.

What partners or service providers have access to PII from Visitors and/or Authorized Users on the Site?

I don’t supply any partners or service providers with PII from Visitors and/or Authorized Users on the Site.

Disclosure of PII to comply with law. I will disclose PII in order to comply with a court order or subpoena to release information. I will also disclose PII when reasonably necessary to protect the safety of our Visitors and Authorized Users. I will require a court order or subpoena. I will not disclose information to a law enforcement body without a court order or subpoena. I will not give out entire datasets, but require individual requests about specific persons by the court.

How does the Site keep PII secure?

All of the Site’s authors, editors and administrators are familiar with our security policy and practices. The PII of our Visitors and Authorized Users is only accessible to a limited number of qualified employees who are given a password in order to gain access to the information. I audit our security systems and processes on a regular basis. Sensitive information, such as credit card numbers or social security numbers, is protected by encryption protocols, in place to protect information sent over the Internet. While I take commercially reasonable measures to maintain a secure site, electronic communications and databases are subject to errors, tampering and break-ins, and I cannot guarantee or warrant that such events will not take place and I will not be liable to Visitors or Authorized Users for any such occurrences.

How can Visitors correct any inaccuracies in PII?

Visitors and Authorized Users may contact us to update PII about them or to correct any inaccuracies by emailing us through our contact page.

Can a Visitor delete or deactivate PII collected by the Site?

I provide Visitors and Authorized Users with a mechanism to delete/deactivate PII from the Site’s database by contacting us. However, because of backups and records of deletions, it may be impossible to delete a Visitor’s entry without retaining some residual information. An individual who requests to have PII deactivated will have this information functionally deleted, and I will not sell, transfer, or use PII relating to that individual in any way moving forward.

What happens if the Privacy Policy Changes?

I will let my Visitors and Authorized Users know about changes to my privacy policy by posting such changes on the Site. However, if I am changing my privacy policy in a manner that might cause disclosure of PII that a Visitor or Authorized Customer has previously requested not be disclosed, I will contact such Visitor or Authorized Customer to allow such Visitor or Authorized Customer to prevent such disclosure.
